(St. Paul, MN) -- The Minnesota D-F-L Party is asking the state Supreme Court to order that Duluth Representative Kerry Gauthier's (goth-YEARS) name be replaced on the November ballot with the candidate Democrats nominated to replace him. Gauthier withdrew from the race amid a sex scandal and Democrats in House District 7-B nominated Erik Simonson as their replacement candidate. D-F-L Party Chairman Ken Martin says voters in Duluth, like everywhere else in Minnesota, should have the chance to choose among candidates who are actively campaigning. But Minnesota Republican Party Chairman Pat Shortridge says the D-F-L is "once again attempting to rewrite the rules to serve their partisan political ends." Shortridge says there is no provision in state law that allows legislative candidates to withdraw from the ballot after the primary.
